Open letter to Town Council

April 11, 2012
Fort Myers Beach Bulletin, Fort Myers Beach Observer

To the editor:

Town Council's proposed Consumption On-Premises (COP) in EC Ordinance needs additional thought.

The stated ordinance purpose is "expansion of area designated for consumption and service of" alcohol "to no more than 33 percent of the land area" in the EC (environmentally critical) area with a limit of 100 feet. No one knows the real magnitude of this expansion!

Staff could easily estimate the 16 areas of expansion from maps available to Town staff for each property.

Also, no one knows the 16 current areas of alcohol consumption. Staff can easily find out the 16 current alcohol sales areas!

Does not everyone think that it might be smart to know both the current alcohol serving areas compared to the 16 expanded areas! Interesting inequalities are bound to show up.

I am told that there are about 3,500 lineal feet of beach width for all 16 properties. If the average outward alcohol expansion were only 25 feet, that would still amount to over four football fields of business expansion onto the beach.

Even the 1,600-square-feet total limit per property discussed at the last Council meeting exceeds the 1,106-square feet as currently the largest beach incursion that Town Staff noted.

I am asking that Town Council understand in defined square footage what they are leaping from and what they are leaping into.
